1. Acceptance of Terms

By accessing or using the Our Moments web application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Our Moments is a private, multi-user web application designed for couples to upload, store, share, and query their photos using natural language processing. The Service is provided "as is" and relies on third-party APIs including Google Gemini Vision API for photo analysis and Supabase for cloud infrastructure.

3. Account Registration

To use the Service, you must sign in using a Google Account via OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4. User Content

Ownership: You retain all ownership rights to the photos you upload or import to the Service ("User Content").

License to Us: By uploading or importing photos, you grant us a worldwide, non-exclusive, royalty-free license strictly to store, process, and display your User Content for the sole purpose of operating the Service for you and your explicitly invited partner. This includes processing your images through the Google Gemini Vision API to answer the search queries you initiate.

Acceptable Use: You agree not to upload any User Content that is illegal, infringes on intellectual property rights, violates privacy rights, or contains malicious code. We reserve the right to remove any User Content that violates these Terms or our policies.

5. Subscriptions and Pricing

The Service offers various pricing tiers, including a free tier with limited uploads/queries, and paid premium tiers (Starter, Pro, Couple Unlimited).

• Payments: All payments are processed securely by Stripe. By upgrading to a paid plan, you agree to provide current, complete, and accurate purchase and account information.
• Renewals and Cancellations: Monthly and annual subscriptions automatically renew unless canceled before the next billing cycle. You can cancel your subscription at any time; access to premium features will continue until the end of the current paid period.
• Usage Limits: Usage is strictly bound to the limits defined by your selected pricing tier. If limits are exceeded, you may be required to upgrade your plan to continue using certain features.

6. Third-Party Services and Disclaimers

Our service acts as a bridge connecting your data to powerful third-party platforms. Your use of Our Moments is additionally subject to the terms of these services (e.g., Google API Services API Terms, Stripe Checkout Services).

Disclaimer of Warranties

The Service is provided without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, totally secure, or error-free. The AI search features derive from probabilistic models and may return inaccurate or unexpected results based on your photos.

7. Limitation of Liability

In no event shall Our Moments, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use or alteration of your transmissions or content.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
